Introduction

These terms of use govern your conduct in connection with the "Product Reviews" service offered by Douglas.

By submitting your product review to Parfümerie DOUGLAS GmbH & Co. KG, you agree to these terms of use and guarantee the following:

Participation Requirements

All natural persons who are 18 years of age or older and have a Mein Douglas customer account for the website www.douglas.de are eligible to submit a product review. Companies, legal entities, or other organizations are not eligible to participate.

You can submit a maximum of one review per product within four weeks.

For submitting a product review, you will receive 5 Beauty Points credited to your account after review and publication. You can earn a maximum of 100 Beauty Points per month for submitting product reviews.

Content of the Review

You are obligated to ensure that your product reviews:

Contain only truthful and non-misleading information,
Maintain a respectful tone,
Do not contain content for which you have received payment or any other compensation from a third party,
Do not contain content that infringes on the rights of third parties, is otherwise unlawful or infringing, or violates good manners or moral standards.

You may only publish your product review if you are the sole author or if the author has explicitly granted you permission for the use outlined in these participation conditions. You may not submit product reviews that refer to other websites, addresses, email addresses, contact information, or phone numbers, or that contain a computer virus or other potentially dangerous computer programs or files.

You acknowledge that you, and not Douglas, are responsible for the content of your submission. Therefore, you are responsible for ensuring that your product reviews comply with applicable law.

Publication of the Review

Product reviews are typically published within one to four working days. However, Douglas reserves the right to remove or reject any submission for any reason.

We are entitled (but not obligated) to review product reviews and block or delete them at our discretion without prior notice.

However, you can request at any time that we delete any or all reviews you have created, although this process may take some time.

Advertising with Product Reviews by Douglas

We and other companies associated with us in the Douglas Group (e.g., parfumdreams.de in Germany, douglas.at in Austria, or douglas.ch in Switzerland, hereinafter collectively referred to as “Douglas”) may use your product review to promote the respective products on other platforms. This particularly applies to the stars you have awarded to the product and the texts you have published in the product review. You grant Douglas a non-exclusive, free, unlimited right in time and space to use these contents for the advertising purposes described. This includes the use and reproduction in all media, especially in the following formats:

Online media (i.e., especially on own and third-party websites and apps)
Own or third-party online shops
Own or third-party social media appearances
Newsletters
Douglas stores
Print media
TV and video

Douglas is entitled to edit your content for this purpose (e.g., by shortening or translating texts) as long as the content is not distorted.

Along with the product review, Douglas may publish certain information about you to help other users better understand your review (namely, your username, gender, age group, skin type, skin color, and hair color).

If you no longer wish your product review to be used for such advertising purposes, you can inform us at any time. We will promptly stop and delete the corresponding advertisement (please understand that this may take a few days depending on the online medium involved).

Advertising with Testimonials by the Manufacturer

The respective manufacturer of a reviewed product and its affiliated companies, domestically and abroad (hereinafter collectively referred to as the “Manufacturer”), may use your product reviews to advertise their respective tested product on other platforms. This particularly applies to the stars you have awarded to the product and the texts you have published in the product review. You grant the Manufacturer a non-exclusive, free, unlimited right in time and space for the described advertising purposes as follows: The advertising will focus on the Manufacturer’s advertising, especially in

Online media (i.e., especially on own and third-party websites and apps)
Social media appearances
Own or third-party online shops

This excludes advertising in newspapers or magazines, on public posters, or on television. The Manufacturer is entitled to edit your content for this purpose (e.g., by shortening or translating texts or by color correction/cropping of your images and videos), as long as the content is not distorted.

Along with the testimonial, the Manufacturer may publish certain information about you to help other users better understand the testimonial (namely, your username, gender, age group, skin type, skin color, and hair color).

If you no longer wish your testimonial to be used for such advertising purposes, you can inform us at any time. We will notify the Manufacturer of your objection, and they will promptly stop and delete the corresponding advertisement (please understand that this may take a few days depending on the online medium involved).

Indemnification from Claims

By submitting content, you agree to indemnify Parfümerie DOUGLAS GmbH & Co. KG (as well as its managing directors, directors, representatives, proxies, authorized agents, assistants, affiliated companies, employees, and external service providers, in particular Bazaarvoice, Inc.) and hold them harmless from any claims, demands, damages, and consequential damages of any kind, known or unknown, including attorneys' fees, arising from non-compliance with the terms of use, a violation of legal provisions, or a breach of third-party rights.

Data Protection

The protection of your personal data is very important to us. You can find our general data protection information here. In the event of a conflict between Douglas’s privacy policy and these terms of use, these terms of use shall prevail in relation to the product review service. By participating in the customer review service, you agree to the processing of the personal data you submit as part of the evaluation of review results.

Dispute Resolution Procedure before a Consumer Arbitration Board

We are not obligated or willing to participate in dispute resolution procedures before a consumer arbitration board.
